The general terms and conditions of business are the basic foundations of business, but in any case, humanity and reason come first, which is a priority for pleasant and successful business. For all additional questions and ambiguities regarding specific situations, we are available to you via the e-mail pik@pikstudiol.si. We will do our best to find a common language and find the most favorable solution.
ARTICLE 1 – PHOTOGRAPHER AND SUBSCRIBER
PIK Lifestyle photography & design is the name under which the team of photographer and designer works, led by Petra and Kristjan, based in Slovenia, Dolenjska region. The photographer has more than 15 years of experience in photography and working with clients. She specializes in photography in several areas, from weddings, pregnant women, newborns, families, portrait photography, product photography, photography of events, sacraments, or depending on demand. With many years of experience, the field of design also includes professional post-production (photo processing) and graphic design (designing casual prints such as wedding prints, invitations, thank you cards, etc. or business graphics such as a comprehensive graphic image, etc.
Photography takes place only by prior agreement via e-mail at the address pik@pikstudio.si, after filling out the inquiry form on the website www.pikstudio.si (the same applies to design services). The photographer currently works exclusively in the field and with the possibility of setting up a mobile studio using photographic equipment at home, exclusively for the execution of lifestyle photography, where the emphasis is on authentic photography in the home environment or on location by prior arrangement.
All published content on the website www.pikstudio.si, including photographs, is owned by PIK - Lifestyle photography & design and is copyrighted, unless otherwise stated. Appropriation of these works without the written permission of the authors is prohibited and punishable.
"Client" refers to the natural or legal person who enters into an agreement or contract with the photographer for the performance of photographic services, places an order, or confirms an offer. The client is responsible for payment of the service and any additional costs such as travel expenses, location fees, permits, etc., unless otherwise agreed in writing in advance.
ARTICLE 2 – OBLIGATIONS OF THE CUSTOMER
By ordering and reserving the photography service via the form on the website https://pikstudio.si/ or email pik@pikstudio.si, the customer undertakes to be familiar with the execution, price, deadline, date and method of payment, which confirms that he agrees to the general terms and conditions. The prices of the services are published in the price list or offer, which the client receives upon request and is forwarded via e-mail.
The client must provide PIK with accurate information about the scope, time of photography, location of photography and his wishes. In the case of a wedding, the client or the wedding organizer is obliged to fill in a record of the wedding day (and key moments: i.e. throwing bouquets, cutting cakes, speeches, surprises, group photography, etc.), prepared by PIK, on which he writes down all the necessary information, which photographers need them to take photos.
PIK takes into account the written information and wishes (if feasible) on the wedding day. The minutes can be adjusted and supplemented at any time before the wedding. Complaints about missed moments that were not recorded in the minutes will not be taken into account after the wedding day.
The client arranges for the photographer to be entertained if the photo shoot is longer than 6 hours. In the event that the reception for the photographers will not be taken care of, the client is obliged to announce this in the minutes of the wedding day, and the photographer has 90 minutes during the reception of the wedding party to prepare the meal himself.
The customer is responsible for his own safety. PIK is not responsible for injuries that occur as a result of taking photos.
PIK and the client resolve misunderstandings amicably. Under no circumstances may the client publicly (via blogs, forums, social networks, etc.) insult, slander, perform or embarrass PIK or the photographers personally. In the event of a misunderstanding, PIK will take action in accordance with legal options. If the resolution of a possible dispute cannot be reached by agreement, or insults or defamation occur via the Internet and social networks, the client and PIK resolve the dispute through the competent court.
ARTICLE 3 - OBLIGATIONS OF THE PHOTOGRAPHER
Before signing the contract, PIK is obliged to draw up an offer according to the client's wishes. The PIK is obliged to arrive at the agreed location of the photo shoot at the agreed time, written in the minutes of the wedding.
The photographer will take pictures of the items included in the offer. The photographer's responsibilities include photographing and accompanying the client on their wedding day. PIK undertakes to try to advise and help during the photo shoot, as part of the relationship and good will, to the extent that this is the client's wish and this will not prevent or make it difficult for the photographer to take photos. The photographer is not a wedding planner.
PIK undertakes to provide the service in accordance with the General Terms and Conditions. He will perform the agreed service and deliver the final product within the agreed period. The photographer is responsible for his own safety.
ARTICLE 4 – DATES AND LOCATIONS
PIK and the client shall agree upon and confirm the exact date, time, and location of the photo shoot no later than 14 days prior to the commencement of the service in region of Slovenia.
Travel costs are included in the package price depending on the selected package or the offer provided. If not included, travel is charged at €0.43/km, with both directions (round trip) counted. Mileage is calculated based on the shortest or most appropriate route.
Photography Abroad (Outside Slovenia):
Due to logistical requirements such as air travel, accommodation, and transport arrangements, timely booking of the appointment is required for photography sessions outside Slovenia. The timing depends on the location and transport availability. The client agrees to make the reservation sufficiently in advance to allow proper preparation and execution of the service, including the possible purchase of airline tickets and booking of transportation and/or accommodation if necessary. We recommend that the reservation be made at least 30 days or even more prior to the desired date, unless otherwise agreed in writing.
For travel outside Slovenia, costs are adjusted based on specific needs and requirements, and may include airfare, accommodation, and other logistics, depending on the client’s preferences. Travel expenses are settled along with the payment for the photo shoot.
Additional costs:
Entrance fees to locations, photography permits, airline tickets, tolls, parking fees, and other travel-related costs are not included in the service price and are covered by the client, unless otherwise agreed in writing or specified in the offer.
If the photo session takes place abroad or in remote/difficult-to-access locations, an additional fee may be charged for logistical planning, travel, or accommodation, which is determined in advance during the offer preparation stage.
ARTICLE 5 - ARE RESERVATION AND PAYMENT
The client confirms the reservation of the appointment and the order of services by making a payment in the amount of 30% EUR of the amount on the offer in the case of a wedding, and for other photographic services full payment (total 100% of the amount) according to the proforma invoice by transfer to the transaction account provided by PIK.
Until payment of the deposit by the client, the appointment is not reserved, unless otherwise agreed by PIK and the client. By paying deposit, the client's reservation is confirmed, and the selected photography package is finally booked.
The booking fee includes the reservation of the selected photography date. The fee does not cover the photographer's expertise, the time spent on the actual photography, photo editing, digital photographs, or printed products. The booking deposit fee is deducted from the final amount due. The remaining balance (totaling 100% of the agreed amount) is payable by bank transfer to the designated account at least 30 days prior to the photography service. If payment is not made within this agreed timeframe, PIK is not obliged to perform the service, and the booking fee will be retained.
In case the client cancels the scheduled session, the booking deposit fee is retained as compensation for the potential loss of income.
In the case of photographing a newborn, for the sake of easier organization and above all availability, a reservation is required at least 1 month before the expected date of birth, so that we can provide you with an appropriate appointment.
ARTICLE 6 – TERMINATION OF SERVICE
If the client cancels the order, PIK keeps the paid deposit. If the price has not been paid, upon cancellation of the order, PIK issues an invoice for canceling the booking of the photography session in the amount of 30% of the amount in the offer.
The booking fee paid by the client for reserving photography services is non-refundable in all cases of cancellation by the client. This applies even in cases of cancellation due to unforeseen events such as force majeure (death, death of an immediate family member, serious traffic or health-related accidents, pregnancy complications, etc.).
If the cancellation of services is initiated by the provider for reasons unrelated to the client, the client will be refunded the full amount of the booking fee. The provider reserves the right to cancel only in exceptional and justified circumstances.
In the case of rescheduling the photo session, PIK undertakes to do its best to find and offer a new free date for the photo session.
In the event that the client decides on a date on which PIK is free, the paid deposit is transferred as a reservation for a new photo appointment. If the deposit has not been paid, it is paid when booking a new photo session in the amount of 30% of the amount in the offer.
In the event that the client decides on a date on which PIK is not free, the paid deposit will be withheld. In the event that PIK cannot offer a date, the deposit is delayed. If the price has not been paid, upon rescheduling or canceling the order, PIK will issue an invoice for canceling the booking of the photography appointment in the amount of 30% of the amount in the offer.
The contract between the provider and the client is considered fully executed upon the completion of the photography session on the wedding day. At this point, the service is deemed fulfilled and final. After the event, the full payment is retained, even if, after this time but before the final delivery of the photographs, a divorce or dissolution of the marriage occurs between the clients.
In the event of a divorce or change in the clients’ marital status after the event date but before the final delivery of the edited photographs, no refund of any amounts already paid is possible. The provider commits to delivering the final product on time as per the contract, regardless of any changes in the personal circumstances of the clients.
Engagement Session as a Standalone Service:
In the event that the engagement session has already taken place and the client subsequently cancels the wedding photography services, the engagement session will be charged as a standalone service at the regular price according to the current price list. The discounted rate included in the wedding package no longer applies, as the package as a whole was not fulfilled. In such cases, the client is required to pay the difference up to the full price of the engagement session as stated in the current price list.
ARTICLE 7 - MEASURES TO CONTAIN THE SPREAD OF CORONAVIRUS
If a measure is adopted that is related to and is in effect directly* on the date of the wedding, that gatherings and gatherings of people at weddings and private events are prohibited, the paid deposit will be returned.
If a measure is adopted that is directly related to and is in effect* on the date of the wedding, that socializing and gathering of people at weddings and private events is permitted, but the provision of photography services is prohibited, the paid deposit will be returned.
To the extent that a measure is adopted that is connected to and is in effect directly* on the date of the wedding, that the number of people at the wedding or socializing at private events is limited to up to 50 people (less than 50 people), the paid deposit will be returned to the extent that the client wants to cancel the service. The client has the right to decide on a shorter or cheaper photography package.
Insofar as a measure is adopted that is related to and is in effect directly* on the date of the wedding, that the number of people at the wedding or socializing at private events is limited to 50 or more people (50 or more than 50 people), the wedding is considered feasible and if the appointment is rescheduled or the wedding is cancelled, the paid deposit will not be returned. If the price has not been paid, upon cancellation of the order, PIK issues an invoice for canceling the booking of the photography session in the amount of EUR 300.

ARTICLE 8 - DISTRIBUTION AND UNIQUENESS OF THE SERVICE
After taking the photos, PIK selects the best ones from all the photos taken and computer processes them in the agreed processing style, or in accordance with the previously published work with which the customer is familiar. The finished products are handed over to the client within the agreed period. You receive the photos in digital format online or on a portable medium. The subscriber receives the photos by post, in some cases also in person.
You receive the photos within 14-21 days after the family photo shoot, within 30 days after the newborn photo shoot, and within 90 days in the case of wedding photos, or in accordance with the agreement with the client. In the event of unforeseen events (force majeure - death, death in the family, serious medical complications, ordering of quarantine, etc.) or rescheduling of weddings of other clients and increased scope of work due to the adoption of measures to curb the spread of the coronavirus, PIK reserves the right to deliver photos and products later than agreed.
The client receives the first 5 to 10 photos of the wedding day no later than 7 days after the wedding. The deadline for the delivery of photo books and other printed products depends on the date of the order and the estimated delivery time of the printing company.
PIK will, to the best of its ability, fulfill the client's expectations and take into account the wishes of the photographer. Since each photo is the result of one's own knowledge and current creativity, PIK does not allow complaints about the composition and technique of the photos. The selection of the most beautiful photos and their processing is also a subject of artistic inspiration for photographers. Unprocessed photos (RAW photos) are not available for purchase, as they are not considered a final product. PIK undertakes that the number of photos will be in the range specified in the offer. The number of photos varies depending on the complexity of the wedding, weather conditions and other conditions on the wedding day itself.
ARTICLE 9 - COPYRIGHT AND PUBLICATION OF PHOTOGRAPHS
All photographic materials are and remain the property of the photographer as copyrighted work and intellectual property. Upon payment for the service, the photographer grants the client limited material copyright, specifically the right to reproduce the photographs for non-commercial use. The photographer reserves the right to publish photographs for marketing and reference purposes. PIK may publicly share the photographs for promotional purposes on its website, social media, printed materials, and third-party platforms intended for promotion unless the client explicitly prohibits this in writing no later than the day of the photo session.
If the client prohibits the publication of photographs for promotional purposes, a discretion fee of [20% of the total service amount or a fixed fee, e.g., 20% of the final price] will be added to the service cost. This compensates for the provider's limited ability to use the created material for reference and marketing purposes.
If the client publishes the photographs, they must credit the photographer as "Photo: PIK - Lifestyle Photography & Design." For commercial publication in media, prior permission from PIK is required. Sharing photographs with other wedding service providers (such as makeup artists, florists, wedding planners, wedding blogs, etc.) is permitted with proper attribution. However, sharing photographs with other photographers is strictly prohibited. Any commercial public use of the photographs requires prior written consent from the author.
ARTICLE 10 - WEDDING DAY RESERVATIONS and NEWBORN PHOTOGRAPHS
PIK can accept one wedding photography booking per day, also valid for newborn photography. The PIK team can provide the client with a team of two photographers, consisting of a leader and a co-photographer. The photographers of the PiK team are trained for their work and provide quality service. On the wedding day, they will proudly represent the PIK team and provide quality service.
ARTICLE 11 - FAILURE TO PERFORM SERVICE
In the event that one or both photographers of the team, which should be present on the client's wedding day, are unable to execute the client's request due to unforeseeable events beyond their control (force majeure - death, death in the family, serious medical complications, ordering of quarantine, etc.) the received deposit of the service is returned to the client and PIK no longer has any obligations towards it.
ARTICLE 12 - GIFT VOUCHER AND DISCOUNTS
You can use the gift voucher during the validity period of the voucher for the service indicated on the gift voucher or any other service from our offer, of the same value. Gift vouchers are not cumulative. It is not possible to exchange the voucher for cash, and it is also not possible to return the voucher if it is not used. The gift certificate is not tied to a name, so you can give it away if it has not yet been used. The gift voucher can only be used once and is devalued after redemption.
When using a gift voucher that is out of date or after 12 months from receipt, the gifted service is billed according to the currently valid price list, where the difference is paid by the recipient of the voucher or the one who uses it. In the event that the value of the gift voucher does not cover the entire price of the service, the customer who uses the service and the gift voucher must pay the difference in price.
It is mandatory to reserve an appointment at least two months before the voucher expires, otherwise it will not be possible to reserve an appointment in time.
It is possible to extend the validity of the gift certificate for 1 year with an additional payment of €25. To extend the voucher, inform us about the extension at pik@pikstudio.si no later than 2 months before the voucher expires.
ARTICLE 13 – EXTENSION OF THE PERFORMANCE TIME OF THE SERVICE
PIK undertakes to perform its work on the day of the photographic service for the time specified in the selected package (or specified in the contract). After this time, the photographer's work will be paid an additional €100/hour (or according to the contract) for each additional hour when the PIK team is officially present at the wedding.
ARTICLE 14 - EXTRAORDINARY EVENTS
We reserve the right to postpone the tentative date of the photo shoot due to unforeseen events (illness, death in the family, health problems, etc.) to another date. We also reserve the right to postpone the photo session due to bad conditions such as weather conditions (in the case of family, pregnancy, portrait or any photography in nature, where the appointment is not necessarily fixed and it is possible to change the appointment) or other events that are impossible predict in advance and prevent the usual execution of photography.
When photographing a wedding, the wedding party and clients must not hinder the photographers from getting their own shots. If the photographers missed a certain moment due to the interference of the wedding party (disruption during work or setting up in front of the lens), PiK is not responsible for this.
In the event of unforeseen events (breakdowns, cancellations, theft or destruction of photographic equipment, computers, disks) that would occur during photography, photo processing or during photo distribution, which would mean that the client cannot receive all or part of the photos, PIK will not is responsible for the loss of the original photos taken.
After distributing photos on a USB key or after receiving photos via the Internet, the subscriber is responsible for the photos and their storage. PIK will keep the originals for the next 14 days after sending the photos, but is not responsible for the client's loss or possible destruction of the USB key by the client. If the photos are lost, the photographer can send you the online gallery again, if it is still available, but this type of service costs an additional 20 EUR.
In the event of accidental or intentional destruction of photographic equipment caused by the customer on the day of the photo shoot, the latter is obliged to replace all destroyed photographic and/or hardware equipment at the then current market prices. The same also applies if the person responsible for malicious damage cannot be found on the day of the ordered service.
ARTICLE 15 - PROTECTION OF PERSONAL DATA
PIK undertakes to protect personal data obtained in the process of booking a photography service in accordance with the Personal Data Protection Act. PIK will not use the client's personal data for any other purpose than exclusively for quality photography, communication with the client and forwarding of photos to the client. Personal data is stored permanently. Without the explicit prior written consent of the client, PIK will not forward personal data to third parties or use them for purposes other than those stated in this article.
ARTICLE 16 - VALIDITY OF THE CONTRACT AND GENERAL TERMS AND CONDITIONS
The general business conditions are published on the website https://pikstudio.si. By reserving a photography service at PIK, the client undertakes to have read the General Terms and Conditions, is familiar with them, agrees with them and undertakes to respect them. PIK reserves the right to change the General Terms and Conditions at any time.
